India makes its first anti subsidy sunset review final ruling on welded stainless steel pipes related to China

On June 15, 2024, the Indian Ministry of Commerce and Industry issued a statement confirming the first sunset review of anti subsidy for welded stainless steel pipes and tubes originating from or imported from China and Vietnam. It is recommended to continue to impose a 5-year anti subsidy tax on the products involved in the above-mentioned countries. Specifically, the anti subsidy tax rate for any Chinese manufacturer/exporter is CIF29.88%, while the anti subsidy tax rate for Vietnamese manufacturers/exporters Sonha SSP Vietnam Sole Member Company Limited and Steel 568 Co., Ltd. is 0, and Gia Anh Hung Yen is 0. The countervailing duty rate for Co., Ltd. and other Vietnamese producers/exporters is 11.96%. This case involves products under Indian customs codes 73064000, 73066100, 73066900, 73041110, 73041110, 73049000, 73051129, 73059099, 73061100, 73062100, 73062100, 73062919, 73063090, 73065000, 7306901, 73069019, and 73069090.
On August 9, 2018, the Indian Ministry of Commerce and Industry conducted a countervailing investigation on welded stainless steel pipes originating from or imported from China and Vietnam. On July 31, 2019, the Indian Ministry of Commerce and Industry made a final affirmative ruling on the anti subsidy case. On September 17, 2019, the Taxation Bureau of the Indian Ministry of Finance issued Notice No. 4/2019-Customs (CVD), which decided to impose a 5-year countervailing duty on the products involved in China and Vietnam based on CIF, with China accounting for 21.74% to 29.88% and Vietnam accounting for 0-11.96%. The customs codes of the involved products are 73064000, 73066110, 73061100, and 73062100. On February 11, 2021, the Indian Ministry of Commerce and Industry announced that in response to an application submitted by Kunshan Kinglai Hygienic Material Co., Ltd., a counter subsidy mid-term review investigation will be launched on welded stainless steel pipes originating from or imported from China and Vietnam to examine whether special grade welded stainless steel pipes that meet A * * E-BPE standards will be excluded from the products in question. On February 8, 2022, the Indian Ministry of Commerce and Industry made a final ruling on the anti subsidy mid-term review of the case, ruling that the A * * E-BPE standard special grade welded stainless steel pipes did not meet the exemption conditions and therefore were not excluded from the products involved in the above-mentioned countries. This case involves products under Indian customs codes 73064000, 73066100, 73066900, 73061100, and 73062100.
On September 30, 2023, the Indian Ministry of Commerce and Industry announced that it would initiate the first anti subsidy sunset review investigation on welded stainless steel pipes originating from or imported from China and Vietnam, in response to applications submitted by the Indian Industry Association Stainless Steel Pipe and Tube Manufacturer Association (Delhi) and Stainless Steel Pipes and Tube Manufacturers Association (Gujarat). The subsidy investigation period for the case is from April 1, 2022 to March 31, 2023 (12 months), and the damage investigation period is from 2019 to 2020, 2020 to 2021, 2021 to 2022, and the subsidy investigation period.
